The Serious Consequences of a Fractured Skull

I’m Ed Smith, a Sacramento Personal Injury Lawyer. Most people understand that the skull protects one of the most important organs in the body, the brain. If the brain isn’t functioning, the patient is considered to be braindead. This is what makes the consequences of a fractured skull resulting from a car accident so important.

Management of Substance Abuse after Trauma

Management of Substance Abuse after Trauma

I’m Ed Smith, a Sacramento Brain Injury Lawyer. Substance abuse, especially alcohol intoxication, is the underlying cause of almost half of all traumatic injuries in the US.  One survey showed that 75 percent of intoxicated patients have a prior history of clinically-significant alcohol related life events and 26 percent admit to significant pre-injury alcohol problems.  This means that alcohol abuse disorder is reported to be the most prevalent disease among trauma survivors.  Injured problem drinkers are subsequently more likely to be reinjured, re-hospitalized, and to die compared to normal people.  Despite the high incidence of substance abuse, it is rarely screened for in rehabilitation units.

Rates of alcohol problems are particularly high among those with traumatic injuries, including traumatic brain injury and spinal cord injury.

Links between alcohol problems and traumatic brain injury/spinal cord injury will be described in terms of the prevalence of these problems together and the effects on outcome.  There are persistent stereotypes and myths about substance abuse that may interfere with the implementation of effective screening and intervention programs. Traumatic Brain Injuries in Elderly Victims
Traumatic Brain Injuries in Elderly Victims Present Unique Concerns

Traumatic brain injuries (TBI) can be serious, life-altering injuries. Traumatic brain injuries in elderly victims present unique concerns. The most severe traumatic brain injuries can leave the victim with lifelong disabilities and restrictions, even if the victim was previously young and healthy. When a person of advanced age suffers a TBI in a personal injury accident, the harm done can present unique challenges and concerns for the victim and his or her attorney. If not properly addressed during the investigative stage of the case, the elderly TBI victim may find the amount requested as compensatory damages reduced or even denied altogether.

Pediatric Traumatic Brain Injuries

Pediatric Traumatic Brain Injuries

I’m Ed Smith, a Sacramento Traumatic Brain Injury Lawyer. Pediatric Traumatic Brain Injuries can be devastating. Science is just now beginning to learn about the short- and long-term effects of traumatic brain injuries (TBI) to adults. The effects of traumatic brain injuries on children is also being investigated and studied but are, as of present, not fully understood. Making matters worse, some of the symptoms and effects of a TBI suffered in childhood may not fully manifest until later in life. What do parents need to know about childhood TBIs and the effects this may have on their child’s development?

Incidence of TBIs Among Children

According to the Brain Injury Association of America, TBIs are the primary cause of childhood disability and death. According to statistics maintained by the Centers for Disease Control and Prevention:

Common Myths Associated with Traumatic Brain Injuries

Common Myths Associated with Traumatic Brain Injuries (TBIs)

I’m Ed Smith, a Sacramento Traumatic Brain Injury Lawyer. The human brain is a complex component of the human body. Even today, doctors and scientists have more questions than answers concerning how the brain functions when it is healthy and when it is injured. Given this lack of understanding amongst members of the medical and scientific community, it should be no surprise that individuals who lack a medical or scientific background also do not fully grasp the complexities of the brain. This lack of understanding and information about the brain and how it is impacted by injuries has led to the creation and circulation of numerous myths regarding traumatic brain injuries (TBIs).

These myths are not harmless: a TBI patient or his or her family members who hold to these myths may mistakenly accept settlements or compensation for their injuries that are far less than what they could obtain had they been properly informed. It is always advisable that you and/or your family speak with a Davis TBI attorney as soon as possible after a TBI injury to learn about your legal rights and how best to protect them.

Common Myths Regarding TBIs

Although it is unclear where or how many of these myths began, they have been repeated numerous times and spread across the country. It is important to separate myth from fact when it comes to TBI injuries: only then can you make an informed decision about whether to proceed with a TBI injury lawsuit or attempt to resolve your injury dispute through an alternative means. In addition, believing a myth regarding TBIs can lead you to forego necessary medical treatment and fail to properly protect your legal interests. Continue reading ›

Loss of smell from a TBI (Traumatic burn injury) is estimated to occur in 25 % of all brain injuries but is often overlooked.

As a Sacramento TBI (traumatic brain injury) lawyer since 1982, I’ve handled hundreds of Traumatic Brain Injury cases resulting, for the most part,  from auto or motorcycle accidents.
Occasionally, it appears that my  client was unconscious at the scene or had an altered state of consciousness such as dizziness or confusion.  Medically, whether the client was unconscious or simply in a daze, he or she is considered to have a traumatic brain injury (TBI).
