Pedestrian Death Occurs in Restaurant Parking Lot on Power Inn Road

A pedestrian death was reported in a Sacramento restaurant parking lot on August 24. The accident was said to occur at about 3:30 in the afternoon on Power Inn Road, close to Fruitridge Road, at the Chando’s Tacos parking lot. When officers with the Sacramento Police Department arrived, they discovered that the pedestrian, described as a male in his 30s, had suffered life-threatening injuries.

Pedestrian Death Accident Details

Emergency responders with the Sacramento Fire Department declared the man dead upon arrival. The name of the deceased pedestrian has not been released pending notification of the family. Officers investigating the case said the driver who struck the pedestrian remained at the accident site. However, according to authorities, an argument between the driver and pedestrian might have precipitated the incident. Although the driver was detained, no information has been released on whether an arrest was made.

Losing a Loved One Due to a Wrongful Death

No one is prepared for the loss of a loved one by a negligent act. It is a difficult time for the family as they face the consequences of another’s action. When this occurs, the family is consumed by feelings of anger, disbelief and a need for justice.

Justice in a Pedestrian Death

Wrongful death is caused by another’s lack of care or disregard for the safety of others. When this happens, family members are suddenly wondering how they will survive without the love and support the decedent provided.

The answer to this is that the party or entity that caused their loved one’s death is financially responsible for the family’s monetary loss. While this will not lessen their grief or bring their loved one back, it will enable them to meet their financial obligations and deal with the decedent’s passing. In short, a wrongful death lawsuit puts the defendant on notice that their behavior was wrong.

Punitive Damages in an Egregious Accident

On some occasions, the negligent act is so egregious that other types of damages are leveled at the defendant. These are called punitive damages, and they are meant to punish the person or entity for their acts. Such damages are awarded when a repeat drunk driver causes serious injuries or death to a plaintiff.

Investigating a Pedestrian Death

Our law firm sends investigators to the accident scene to examine the site and gather evidence against the at-fault party. It is essential to do this in a wrongful death case since the deceased can no longer speak for themselves. Our protocol includes the following steps:

  • Our investigators interview witnesses since they can provide a first-hand account of what happened. In some cases, a witness has captured the accident on their cell phone.
  • We acquire videos of the accident from several sources, including traffic light cameras and business surveillance units.
  • Our investigators use accident reconstruction techniques that map the incident as it occurred.
  • We review the police report, a document widely used by insurers and in civil court, for mistakes.

Once all the data is compiled, our investigators turn it over to our legal department. Our lawyers use it to build a robust case for our clients.
