Foothill Farms Accident Results in Major Injury

An accident in Foothill Farms on Roseville Road on January 1, 2020, was due to a vehicle spinning out of control and ending up in a resident’s backyard. The incident happened about 100 yards from Tacomic Drive at approximately 2:05 in the afternoon. A Lexus ES500 hit a residential fence, struck the back wall of the house, and passed into the backyard. According to reports by the California Highway Patrol (CHP), the vehicle remained running and caught on fire. Witnesses said the homeowner was outside trying to put out the fire. A major injury in the accident was reported by the authorities, and the person was transported to a local hospital. There has been no update at this time as to the injured party’s condition. The CHP has not said if drugs or alcohol were involved. There was no problem with traffic flow due to the accident.

What Causes a Driver to Spin Out of Control

There are varied reasons a vehicle can lose traction and spin out of control. One of the biggest is driver error, such as speeding. When a driver takes a turn too fast, they will be unable to compensate, and the vehicle will be out of control, possibly leading to an accident. There are other reasons:

How to Handle an Out of Control Vehicle

When a car starts to spins out, there are lifesaving things you can do, such as:

  • Avoid panicking. This will make you exaggerate your reactions.
  • Don’t brake: Braking will make the situation worse.
  • Slowly take your foot off the accelerator. This gives the vehicle’s tires a chance to regain their grip.
  • Steer straight ahead. If you need to turn to avoid an accident, move the wheel in small increments.

Liability

When you lose control of your vehicle due to driver error, you are responsible for the damages you caused. But, what happens when your loss of control is due to something or someone else? In this case, you may have the ability to file a personal injury claim. For instance, let’s say that you were heading for a sharp curve in the road that you were unaware of. The governmental agency in charge of roads had failed to post signs warning drivers that a curve was ahead. Unfortunately, your vehicle took the curve at an inappropriate speed and went out of control. The damages you or anyone else on the road incurred reflect back to the city’s negligence. Your attorney can file a civil claim against the city to recoup your medical bills, property damage, and lost wages. There is a difference in the time you have to file when you are dealing with a government body. If the claim is filed later than six months against the city, your case will not be heard. Your attorney will ensure this does not happen.

How an Attorney Can Help

At our firm, we search for the reasons why an accident happened. We don’t limit our search to the obvious causes. Instead, we send our investigative team to look for evidence at the accident site. They interview eyewitnesses who saw the crash happen, obtain video footage if available, and use accident reconstruction techniques to determine liability. Our investigators also review police reports for mistakes. Brake and tire defects are examined as a cause of the accident. In the event that auto defects were involved, it is possible to file a product liability lawsuit against the manufacturer. Once all evidence is gathered, the investigators release it to our legal department to build a strong case for our client.
