When a Wrongful Death Occurs, Compensation Can Be Claimed

We at our law firm have been representing families who have lost a loved one in wrongful deaths since 1982. As a result of negligence, a person’s death may be wrongful, such as in a two-vehicle collision, a motorcycle or bicycle crash or one caused by an outside force such as a defective auto part or poorly maintained road.

A sense of closure and justice can be brought to family members by obtaining compensation, even though it does not ease their grief. In addition, by filing a wrongful death claim, it helps the family avoid the financial stress the sudden loss of a loved one can cause.

What Damages May Be Claimed in a Wrongful Death Case

Wrongful death lawsuits can be filed by immediate family members or the executor of the deceased’s estate. Wrongful death compensation may be awarded for the following:

  • It is possible to recover the costs of the funeral and burial of your loved one.
  • If the decedent had lived, they would have been able to receive wages, pension and insurance benefits, bonuses and other monies that would have accumulated to retirement age. Compensation for that loss can be recovered.
  • The surviving spouse or putative spouse may be entitled to damages for the loss of consortium, affection, moral support and comfort provided by the deceased.
  • The deceased’s children, whether natural or adopted, who lost guidance, nurturing and training from their parent can seek compensation for those damages. Stepchildren may join a claim if they obtained at least 50 percent of their financial support from the decedent. Also, children of a decedent’s deceased offspring may be members.
  • There can be a recovery of damages from the loss of inheritance.
  • A survival action can be filed if the deceased family member lived for a period of time before passing away and is placed on behalf of the loved one who died. In this case, damages are often similar to those for wrongful death, but the decedent’s medical expenses are also included.
  • In the event of a decedent’s wrongful death, loss of services, which includes household tasks they performed such as preparing the yearly tax return, caring for the children or gardening, can be claimed as damages.
  • The family may ask to be awarded punitive damages if an egregious or intentional act caused the death. These damages do not compensate the family for their loss. Generally, these can be filed in a survival action to punish and discourage the offender.
