Green Valley Road Location of Rescue Roadway Fatality Crash

A Rescue roadway fatality was reported in El Dorado County on November 10 following a head-on collision between two vehicles west of Placerville. The collision, which involved an SUV and a sedan, occurred at the Green Valley Road intersection with Oak Lane Drive at about 4:50 p.m. One person was found lying on the ground when California Highway Patrol (CHP) officers arrived.

Vehicles Towed as Evidence After Rescue Roadway Fatality Collision

A reporting person who called the police also reported hearing additional vehicles rear-ending each other in the distance. A medic with the Rescue Fire Department declared one party deceased at the accident scene. The vehicles involved in the crash were towed as evidence. A determination of the accident’s cause is underway by the CHP traffic crash unit. The county coroner’s office will release the decedent’s name when the family receives notification of the death.

Cases Involving Wrongful Death

When a Rescue roadway fatality accident occurs, and it turns out the other driver was at fault, a wrongful death claim may be placed to recover compensation in connection with the Rescue roadway fatality. The estate administrator or the surviving spouse and children in the family may file the claim. If the deceased had no spouse or children, the next in line to file would be the parents and siblings. Only one claim may be filed.

Filing a Claim Within the Statute of Limitations

Because the statute of limitations in California for personal injury cases is two years, the wrongful death lawsuit must be filed before that time expires. However, it is best to begin as soon as possible because evidence has to be gathered by the lawyer’s investigators to support the claim. Waiting too long to file may make the witnesses challenging to locate, and the evidence disappears.

The Recovery of Damages in Wrongful Death Cases

The surviving family members may be entitled to recover a variety of damages from filing a wrongful death claim, including:

  • The costs associated with funerals, burials, and cremations are recoverable.
  • The demise of a loved one resulted in financial losses, such as their earnings and benefits, which can be recouped.
  • The loss of loving companionship, guidance, and a sense of moral support is compensated.
  • Punitive damages may be awarded for exceptionally egregious negligence which led to the death.

Advice from a Wrongful Death Lawyer

Obtaining compensation for your loss is easier if you speak with an experienced California wrongful death lawyer as soon as possible. As your attorney guides you through the compensation process, he or she can help you understand your rights. Generally, personal injury lawyers offer free consultations and work on a contingency basis. In other words, you don’t owe the lawyer anything until your claim has been concluded successfully.
