How is Fault Proven in a Head-On Collision Case?

Head-on collisions are often traumatic and life-changing for all involved parties. These crashes tend to be catastrophic due to the impact velocity involved. Reasons for these auto accidents vary but often include falling asleep at the wheel, unsafe passing, driving under the influence, distracted driving, etc. As with any motor vehicle collision case, an injured party must prove that the other side’s negligence was the cause of the incident to recover financial compensation. Evidence may include medical records, video surveillance footage, police reports, eyewitness accounts, etc.

In some cases, liability for a traffic crash may be clear. For instance, if a motorist unsafely enters the oncoming traffic lane and collides head-on with another vehicle that is traveling in the correct direction, the wrong-way driver is most likely to be held fully accountable for the incident. In other cases, liability may be disputed for the crash. That is why it is helpful to have an experienced injury lawyer on your side after a head-on collision. An attorney will work to ensure that fault is not unfairly placed on you for a car wreck and build a strong case for full financial recovery on your behalf.

What an Attorney Can Do For You and Your Personal Injury Case

While the two-year statute of limitations may seem like ample time to file a case in civil court, it is essential to consider what all goes into building these cases. They require substantial time and effort for preparation. Here is what a California car accident lawyer can do for you and your case:

  • Gather all medical records to document accident-related injuries
  • Order traffic incident reports by officials that responded to the crash
  • Handle communications with the insurance carrier and file an injury claim
  • Review all settlement offers from the insurer to determine if it covers all losses
  • File a lawsuit in civil court if a mutual settlement agreement is not reached with the insurer
  • Litigate the case in an effort to resolve the matter in the best interests of the injured party

Before an injured party retains legal counsel, claims adjusters are often quick to make a settlement offer at the start of the case. Remember that the first settlement offer will most likely be far less than you deserve. Therefore, it is best to have a lawyer on your side.
