Negligence and Personal Injury Claims Involving a School Bus
All personal injury claims rest on the grounds of negligence or intentional actions that result in harm. An injury lawyer evaluates the case to determine if the prospective client can claim compensation from the negligent party. If a claim is viable, the lawyer performs an investigation to collect evidence supporting the injured individual’s case.
With evidence from the Galt school bus crash, the lawyer builds a strong case to back the client’s claim. This evidence serves as a foundation during negotiations with the at-fault party’s insurance company. Should the insurer refuse to provide fair compensation, the lawyer can present the evidence in civil court for resolution.
What Damages Can I Recover by Filing a Personal Injury Claim?
Recovering damages after a Galt school bus crash involves multiple factors, such as the injured individual’s income and age. However, typically, if the injury results from someone else’s negligent behavior, the following damages can be claimed:
- Medical expenses: The injured individual can seek compensation for all medical costs arising from the accident, including hospitalization, doctor’s fees, surgeries, and rehabilitation. If the injury persists into the future, expected additional costs can also be claimed.
- Lost wages: Injuries from accidents often prevent the individual from working, leading to loss of income. Compensation includes lost wages and the value of job-related benefits. If the individual must take a lower-paying job due to their injuries, the difference in pay is recoverable. In cases of permanent disability, wages are calculated up to retirement age.
- Pain and suffering: Compensation for physical and emotional pain and suffering can be pursued. Emotional suffering includes conditions like anxiety, insomnia, nightmares, and depression. In many cases, the injured party may develop post-traumatic stress disorder (PTSD) and require professional treatment for their symptoms.
