What is Wrongful Death?
When a loss of life occurs from someone else’s negligence, it may be deemed wrongful death under California law. Negligence refers to the carelessness or recklessness of another party or entity. When this occurs, surviving family members may be eligible to file a claim for wrongful death against the other side for economic and non-economic damages incurred. This may include mental anguish, loss of companionship, funeral costs, lost earnings, and more.
There is a limited amount of time to file suit. This is based on the statute of limitations that applies to the matter. Per CCP 335.1, a case for wrongful death must be filed within two years. Once the time limit has expired and the case is not filed, the matter may be dismissed by the court. In other words, the family may lose the right to seek damages. Protect your right to financial recovery by retaining legal counsel as soon as possible.
Do You Need a Lawyer for a Wrongful Death Pedestrian Accident Case?
It may be challenging to prove wrongful death without legal counsel, especially when liability is disputed and difficult insurance companies are involved. When a family loses a loved one in a pedestrian accident through someone else’s negligence, it is in their best interest to contact an accident attorney immediately. A lawyer with experience in California wrongful death law will analyze the facts and circumstances involved in the case, investigate the matter, and consult with expert witnesses to prove liability and the damages incurred.
Unlike the other side, a wrongful death attorney will work to protect the family’s rights and seek full financial recovery on their behalf. A family can depend on their lawyer to gather evidence, provide reliable support and guidance throughout the claims process, and use their expertise to secure a favorable outcome in their case. If the attorney has exhausted all attempts to negotiate a favorable settlement agreement with insurers and other involved parties, the lawyer will file the case in court and move forward with litigating the matter.
