Seeking Justice and Financial Recovery in a Wrongful Death Auto Accident Case

Coping with the loss of a family member is always a challenging experience. However, when that loss is the result of another party’s careless or negligent actions, the grieving process may be more challenging as it may be compounded by anger and frustration. While no amount of compensation can truly replace a close relative, taking legal action against responsible parties may offer a means to obtain justice and seek financial compensation. An experienced attorney can help surviving family members through the wrongful death claims process and help during this difficult time.

After a catastrophic crash resulting in a loss of life, it is common for survivors to question if they have grounds to file a wrongful death action against the at-fault party. To proceed with a claim for damages, there are basic guidelines that must be met under California law. Wrongful death is a loss of life where an individual, aside from the decedent, is responsible and caused the fatal incident through negligence or carelessness. Motor vehicle collisions are a common example of a situation that may lead to a wrongful death case. These matters are civil cases intended to seek justice and financial recovery.

In many wrongful death claims, close relatives may have depended on the decedent for financial support. A case will account for this and provide a means to seek reimbursement for end-of-life medical bills (via survival action), funeral service arrangements, loss of financial support, and other economic damages experienced by surviving family members. In these matters, clear and compelling evidence and documentation are necessary to demonstrate the actual losses to establish what reasonable and appropriate compensation should be.

How an Attorney Can Help With a Wrongful Death Car Accident Claim

Naturally, a family’s primary concern is finding solace and coping with grief following the passing of a close relative. Legal action may not be a top priority for surviving family members, especially when trying to figure out how to make ends meet and adapt to the void they have left in their lives. Survivors have been deprived of the emotional and financial contributions that their beloved family member made, and the at-fault party should be held accountable for their actions. While a family focuses on rebuilding their lives, an attorney will dedicate their efforts to protecting their rights by:

  • Conducting an independent investigation into the underlying circumstances and facts of a fatal incident
  • Gathering and preserving all available and relevant evidence to use later and build the strongest wrongful death case possible
  • Identifying the individual or entities who may be held liable for their actions that caused or contributed to the fatal accident, including determining what insurance policies may apply
  • Working with expert witnesses, including economists and crash reconstruction specialists, to help provide a compelling explanation of how the opposing party caused the fatal incident and what reasonable and necessary compensation is
  • Negotiating with insurance companies and defense counsel to reach a mutual agreement that compensates surviving family members to the maximum extent possible or filing a case in civil court to litigate the matter if all efforts in negotiations have been exhausted
