What Surviving Family Members Should Know About Wrongful Death Cases

When an individual has lost their life in an accident due to the negligent actions of another party or entity, surviving family members may bring a wrongful death action against those responsible to seek financial compensation for their losses. Such cases may stem from a wide array of fatal accidents, including motor vehicle collisions. Surviving spouses, domestic partners, and children have priority under the California Code of Civil Procedure Section 377.60 for bringing such cases forward, followed by the stepchildren, parents, and putative spouse of the decedent if such parties are not present.

Like other civil cases, wrongful death claims are generally subject to a two-year statute of limitations to be admissible in court. If the deadline is not met, the court may dismiss the case, and survivors may be barred from seeking financial recovery. Much shorter deadlines for filing these cases may apply if they involve a government entity. Under the California Government Code Section 911.2, families have six months to file a notice of claim. Since the claims process may be challenging to navigate, it is essential to retain legal counsel as soon as possible to allow the lawyer ample time to build a strong case for fair compensation.
