Fairfield Injury Collision Lawsuit

I’m Ed Smith, a Fairfield auto accident attorney. On Wednesday, August 2, 2017, a local news source reported that a case management conference regarding a lawsuit filed by an individual who was injured in a collision on campus of Solano College has been scheduled for October 18. A review of the details regarding the Fairfield car accident as well as more about the lawsuit follows below.

The Accident

The accident occurred on Friday, September 9, 2016, at about 9:15 in the morning when an employee of Solano College driving a black Acura SUV drove their vehicle into the wall of a classroom on Solano College’s Fairfield campus. After colliding with the wall, the vehicle drove into the classroom and injured nine students who had been testing inside.

Solano County Sheriff Department Deputy Christine Castillo responded to the incident and told reporters that the driver was probably not under the influence of intoxicants. She also noted that the crash may have happened as the result of the driver having a seizure.

Injuries

Altogether, ten people were injured in the collision, including the driver of the vehicle. Seven of the injured testing students were hospitalized, three with moderate injuries. Three other students were treated at the scene of the collision for minor injuries. Additionally, the superintendent-president of the college, Celia Esposito-Noy, noted that the collision could have been much worse, as the classroom had been relatively empty compared to a short while earlier.

Recompense Sought

Maricris Fragoza, one of the students injured in the collision, has cited $19,000 in lost wages, medical expenses, future medical expenses, and future earning potential due to the crash. The suit was filed against Solano Community College in early 2017 and contends that the employee was negligently operating their vehicle at the time of the collision.

The college denied the allegations in a court filing.

Filing Claims Against Government Entities

If you have sustained injuries in an incident as a result of the actions of a government entity, it’s important to remember that you only have 6 months, or 180 days, to file a claim. This is different than the time frame for filing claims against private entities, which is typically two years. After filing a claim against a government entity, there are also strict timelines and paperwork regulations that need to be followed.

In order deal with the complicated legal process of filing an injury claim against a government entity, it is best to have a lawyer on your side who knows the specific steps to take.
