Wrongful Deaths in a Lincoln Two-Vehicle Crash

Two-vehicle accidents often cause severe trauma or a fatality. A wrongful death occurs when the driver of the other vehicle was negligent and caused the crash. Some of the ways a driver exhibits negligence are as follows:

  • The driver was intoxicated, either by drug use or alcohol, which led to the Lincoln two-vehicle crash.
  • By driving distracted because they were texting or talking on a cell phone, the driver was looking away from traffic when the collision occurred.
  • The motorist was fatigued from staying up late the night before, which caused them to nod off.
  • The driver was committing a traffic infraction, such as speeding, running a red light, or other violations.
  • The motorist was tailgating and could not stop in time to prevent an accident.
  • The accident was the result of the other driver’s road rage or other aggressive driving.

Recovering Compensation in a Wrongful Death Case

By filing a wrongful death claim after a loved one’s demise in an accident, the family may recover the following:

  • Wages the deceased would have earned until their age of retirement are recoverable, including compensation for their lost benefits.
  • The cost of the funeral and other end-of-life expenses can be recouped.
  • The surviving spouse can recover compensation for their loss of consortium, affection and support.
  • The family’s children may recover damages for the loss of parental guidance and nurturing.
  • Compensation may be sought for the loss of household assistance the decedent provided.
