Child Injured in Modesto Pedestrian Collision

On Wednesday, October 17, 2019, a Modesto pedestrian collision left a child with serious injuries. According to officers of the Modesto Police Department (MPD), the accident happened in the early evening and involved a single vehicle. The child was the only individual injured during the accident, and updates on his medical condition have not yet been provided by staff at the UC Davis Medical Center in Sacramento. The incident remains under investigation.

Crash Details

Police stated that this accident occurred at 4:27 p.m. on Chrysler Drive close to the Prescott Road intersection. A driver traveling west on Chrysler drive reportedly struck a 2-year-old boy who had been playing with a group of other children in the northwest Modesto neighborhood at the time. The driver stopped his vehicle and remained on-scene to assist with response and cooperated with police. The child was reportedly airlifted to the hospital in Sacramento for treatment.

Children and Pedestrian Injuries

Children are more liable than adults to suffer serious injuries during a pedestrian accident. This is the case for a few reasons, including lack of experience avoiding traffic as well as their smaller size. Among some of the more common pedestrian injuries that children suffer are traumatic brain injuries, spinal cord trauma, tendon tears, and bone fractures. Often, fractured bones will include the radius and ulna, which are located in the wrist and forearm.

Because children are growing rapidly, these injuries have the potential to affect their development. In many cases, a childhood injury can affect an accident survivor for the rest of their life if not treated properly.

Can Children Claim Damages after a Modesto Pedestrian Crash?

Children are entitled to the same compensation that adults receive following serious accidents. However, for a child to recover payments for a personal injury, their case needs to be filed by a legal guardian. By filing one of these cases against negligent parties, or by submitting an uninsured/underinsured motorist claim through your own insurer, guardians can claim the payments that their children deserve for medical expenses, personal losses, and other types of damages.

Do I Need to File a Claim Right Away?

The amount of time that you have to file a personal injury claim is different when a minor is injured. For adults, the statute of limitations on injury claims is two years, meaning that the claim needs to be filed within 24 months of the accident date. However, with children, this time limit does not come into effect until they are a legal adult. However, this time limit can vary under specific circumstances, and it’s very important to consult with an injury attorney as soon as you can so that you know how to move forward with your case. Additionally, contacting a lawyer early on often makes it easier to obtain the full amount of compensation your loved one deserves.
