Pedestrian Injured After Stanislaus County Accident

A pedestrian and motorcyclist were both injured after an accident near Westley in Stanislaus County on the morning of April 22, 2020. The pedestrian accident occurred around 10:40 a.m. on Highway 33 and Frank Cox Road, according to the California Highway Patrol (CHP). A 62-year-old Grayson resident was standing along the shoulder of the roadway. For unknown reasons, the pedestrian was involved in a collision with an oncoming 2008 Harley-Davidson Road King motorcycle. The impact propelled the motorcyclist off his bike as it continued north before coming to a stop along the east shoulder of the road, the CHP said. The motorcycle rider was transported by ground ambulance to Memorial Medical Center in Modesto for treatment of abrasions to the right leg and a possible ankle fracture. The pedestrian was believed to have fractured both of his ankles. He was transported via air ambulance to Doctors Medical Center for treatment. Updates, including the cause of the collision and the conditions of the injured parties, were not immediately available.

Stanislaus County Pedestrian Accidents Involving Motorcyclists

A motorcycle striking a pedestrian may result in traumatic injuries to both parties. The person walking is usually hurt from being hit by a motor vehicle, such as a motorcycle. This is due to their lack of physical protection. The rider may be propelled from their bike upon colliding with the pedestrian, sustaining a wide array of trauma or even death. Both parties in these situations are susceptible to suffering chest trauma, spinal cord injury, traumatic brain injury, and other types of potentially fatal injuries. For those seriously injured, it is essential to understand the prognosis of the trauma, as there is only one opportunity to claim monetary damages from those responsible for the crash. Who is at Fault in a Pedestrian Accident Involving a Motorcycle?

Determining fault in a pedestrian-motorcycle accident often requires an extensive investigation. This is due to the evidence that must be collected immediately, statements that must be gathered from witnesses and accident victims, and the police report to be requested and review. To make the situation even more challenging, insurance adjusters are often involved.
Insurance adjusters may use California’s comparative negligence laws to their advantage to unfairly distribute fault among involved parties before an additional investigation takes place. For instance, a pedestrian may be deemed 40 percent at fault in the motorcycle accident, and they would only be able to recover 60 percent of the full settlement amount they would have been entitled to otherwise. By doing so, the insurer can pressure injured people into accepting a low-ball settlement, not fully taking into account all the damages they have incurred. When this happens, an injured person should contact an experienced Modesto personal injury lawyer after a motorcycle-pedestrian accident. An injury lawyer can conduct an independent investigation into the crash to properly determine fault. This way, the injured party will not be unfairly subjected to comparative fault for a collision they did not share liability in.
