Pedestrian Accident in Jamestown

A construction worker was injured in a recent vehicle versus pedestrian accident that occurred on State Route 108/49 in Jamestown. The incident occurred during the early morning on SR-108/49 close to 5th Avenue, officials said.

Details on the Pedestrian Accident in Jamestown

A Caltrans worker, a 52-year-old man from San Andreas, was wearing a hard hat equipped with a halo light and an orange reflective vest at the time of the pedestrian accident. CHP traffic officers indicated that the worker was placing cones out close to the intersection of State Route 108/49 and 5th Street. A recent PG&E power outage the night before prompted Caltrans’ response to ensure that the intersection was safe since the traffic lights did not have power.

A 2022 Subaru Impreza, driven by a 29-year-old man, was traveling westbound on the highway. The driver attempted to make a left onto southbound 5th Avenue. According to the California Highway Patrol, the driver failed to see the Caltrans worker in the roadway and the left front of their vehicle allegedly struck the pedestrian.

The Caltrans worker was transported to the hospital for treatment of moderate injuries. The Subaru driver was later arrested for felony driving under the influence (DUI) and booked into Tuolumne County Jail. Additional information has not yet been released. An investigation by the CHP is ongoing.

Seeking Financial Recovery in a Pedestrian Accident Case

The unfortunate reality is that pedestrians lack physical protection in the event of a motor vehicle collision, potentially leading to serious injuries or even death. Severe injuries may be painful and traumatic for the pedestrian. In addition to the emotional toll, an injured pedestrian may also face severe financial hardship if they contributed to the household income, further exacerbating the impact of the incident and the resulting injuries. Fortunately, an injured pedestrian is not left without options. A personal injury claim may be filed against the at-fault party and their insurance carrier.

Eligible claimants may seek the recovery of wage loss, medical bills, pain and suffering, and other losses in connection with the incident. There may be cases where an injured party may have to fall back on their uninsured and underinsured motorist coverage. This may be necessary if the driver that caused the vehicle versus pedestrian collision has limited liability coverage or no auto insurance. Every case is unique due to the facts and circumstances involved. As such, the value of a personal injury case can be properly calculated with the assistance of a skilled accident lawyer.

The opposing party’s insurer may attempt to dispute the value of a bodily injury claim by discrediting the injured party and attempting to shift blame onto the claimant. There are cases where the insurance carrier may use various approaches to dispute liability, such as claiming that the injured party has a medical condition that is due to a pre-existing injury or that the reported injury is not as severe as claimed to be. To avoid this, it is best to work with an experienced attorney who can build the strongest pedestrian accident case possible to overcome disputes regarding liability, injuries, and damages.

Who Can Be Held Liable for a Pedestrian Crash?

While driver negligence is generally the result of most pedestrian accidents, other parties may be held liable for a crash. An experienced attorney can carefully investigate the circumstances and facts of the matter to identify all potential negligent parties and relevant sources of financial recovery. Other potential defendants may include a government entity for road defects, manufacturers of faulty vehicle equipment, and more.
