Seeking Financial Compensation in a Big Rig Versus Motorcycle Accident Case

Trucking companies and commercial truck drivers often fail to follow state and federal regulations and rules to make quicker trips and increase profit margins. Such violations may increase the risk of big rig crashes occurring in California and throughout the nation. The unfortunate reality is that when a tractor-trailer collision occurs, it often causes serious injuries to those in passenger vehicles, on motorcycles, or traveling by foot or bicycle. If negligence is the cause of the incident, the truck driver, trucking company, or another party may be held liable for damages through a civil case.

Proving the responsibility of a commercial truck driver or a trucking company for the resulting damages usually requires assistance from a skilled and experienced attorney. Under California law, injured parties and survivors have up to two years from the date of the crash to seek damages through a personal injury or wrongful death case. If the statute of limitations is missed, the court may dismiss the matter and bar it from moving forward. As such, it is beneficial for those affected by a commercial truck accident to retain legal counsel immediately to protect their rights.

From our decades of combined experience, our legal team at AutoAccident.com knows where trucking companies cut corners, place profit over safety, and fail to uphold state and federal regulations. Such factors may remain hidden or be overlooked in these cases without this experience. Our team of investigators will examine the incident site and the vehicles involved, gather evidence, and start building a strong case for full compensation. If the other side does not own up to their wrongdoing and agrees to a mutual settlement agreement, we will take the case to court if necessary.

Why are Truck Accident Cases Different?

Some of the most challenging litigation cases today are those involving large commercial trucks. Truckers and trucking companies must adhere to strict state and federal regulations. Attorneys handling these matters must be well-versed in applicable laws to properly establish liability and damages in a truck accident case. This includes regulations and insurance issues overseeing the trucking industry and commercial transport, comparative fault rules that may affect the matter, laws on negligence, statute of limitations, and more.

During litigation, an experienced California truck accident lawyer will help their client assess their options in the matter. This includes weighing the risks and benefits associated with settling the case with the other side or taking the case to court.
