Motorcycle Accident Injures Rider in Sacramento Intersection

A motorcycle accident with a vehicle near the intersection of 22nd Street and J Street occurred at about 11:57 p.m on November 16. The biker was down and appeared to be injured when police arrived. He was transported to a local hospital by paramedics for further evaluation. At the time of this report, the severity of the rider’s injuries are unknown. Officers from the Sacramento Police Department will be investigating the motorcycle accident to determine why it happened and who was at fault. The driver of the motor vehicle involved in the crash remained at the scene and was said to be cooperating with the police. The police department has not said if drugs or alcohol were involved in the motorcycle accident. 

Why a Motorcycle Accident Happens

  • Inclement weather: Motorcycles lose control quickly in the rain due to slippery conditions. This is worse in areas that are drought-stricken since the oils on the road can lead to even greater loss of stability. 
  • Road defects: Potholes and other road defects cause many motorcycle accidents. When an accident results due to poor road conditions, it is possible to hold the city or county agency responsible due to lack of maintenance. 

Intersection Accidents

Accidents at intersections are common. This is partly due to the complexity of intersection traffic. Such accidents may also occur when the traffic lights are not functioning properly or stop signs are hidden from view due to overhanging foliage. When this happens, the agency in charge of road maintenance may be held liable for the accident. In most accidents, the injured party has two years from the time the crash occurred to file a lawsuit against the at-fault driver. However, when the defendant is a governmental agency, the time is shortened. In such cases, the injured party has six months to file a claim with the agency. After that, the agency has 45 days to respond. When the agency denies the claim, the injured party has 180 days to file a claim. If the agency does not respond, the plaintiff has two years to file from the time the accident occurred. This protocol can be difficult to deal with.
