Man Found Dead after Redding Area Rollover

I’m Ed Smith, a Redding car accident attorney. A man was found dead in an overturned vehicle off of Highway 44 just a short distance east of the Stillwater Road intersection on Thursday, February 1, 2018. I would like to offer my sympathies to the decedent’s family and friends.

Accident Details

Authorities were first notified about the accident at about 7:00 a.m. when a driver on Gilbert Drive called about seeing a vehicle partially submerged in a pond off of the side of the highway. Authorities arrived at the accident soon after receiving the report.

Upon arriving, responders discovered that a gold-colored Chrysler Sedan had drifted off of Highway 44 and overturned while traveling down an embankment before coming to a stop on its roof in three feet of water. California Highway Patrol (CHP) spokesperson Jason Morton said that response crews found the driver of the vehicle, an as-of-yet unidentified 47-year-old man, deceased inside of the vehicle after removing it from the water.

Morton added that the sedan was a 1999 Chrysler Concorde and had been registered in the city of Florence, Oregon.

Investigation

Reports indicate that the sedan had been driving eastbound on Highway 44 when it veered off of the roadway between the Gilbert and Stillwater intersection and went over the south roadside shoulder before crashing. Investigators are currently trying to understand why the driver lost control of his vehicle, but authorities say that the causal factors involved in the accident remain unclear.

Possible causal factors involved in this accident include DUI, unsafe roadway conditions, driver distraction, a faulty vehicle part such as steering system or brakes, a medical emergency that caused the driver to lose control, and more.

Auto Products Liability

We rely on our vehicles to operate properly and when an auto accident happens due to a defect in an SUV, car, truck, motorcycle, or another vehicle, the result can be severe. This type of crash can cause catastrophic injuries and even death. When individuals receive injuries due to faulty vehicle parts, they often are able to file what is referred to as a “products liability” claim.

In other words, as with when a reckless driver causes an accident and can be held liable for their actions, the manufacturer, retailer, and/or seller of the defective vehicle part may be liable as well. At a glance, products liability claims have three main criteria which are as follows:

  • The claimant received injuries
  • The part or product at issue was unreasonably hazardous
  • The part or product defect caused the claimant’s injuries

While these criteria may seem simple, products liability claims themselves can be extremely complex and even more time-consuming. Contacting an experienced accident attorney is the best way to make sure that your case is handled correctly.
