Hit and Run Driver Charged in Vacaville

I’m Ed Smith, a Vacaville Motorcycle Accident Attorney. A hit and run accident that left a couple with serious injuries in September is finally being brought to justice. The driver suspected of causing a wreck and then fleeing from the scene, 37-year-old Kenneth Montgomery, has been ordered to stand trial on charges for assault with a deadly weapon and a felony hit and run.

What Happened

According to testimony from both witnesses and the two injured parties, Montgomery had been driving a Volkswagen Passat in the fast lane around 10 AM on September 29, just east of Vacaville on I-80. The Passat reportedly came speeding up behind, within feet, of a Harley Davidson motorcycle and then briefly crossed into the center divide.  The Passat then suddenly reentered traffic striking the motorcycle and ejecting the riders.

Montgomery then continued down the interstate where he pulled over and reported the accident to a California Highway Patrol (CHP) officer conducting an unrelated traffic stop. Montgomery claimed to have seen the accident a few minutes earlier, but had no explanation for reports by other motorists saying his vehicle had been traveling in the median alongside the motorcyclists.

Severe Injuries

The husband and wife injured as a result of the hit and run also testified during Mondays hearing. After slamming into the pavement at 75mph, the husband suffered six broken ribs, a broken shoulder and collar bone, a ruptured spleen, and several lacerations that left scarring which he showed the judge from the witness stand. His wife was also injured after tumbling down the freeway, sustaining a broken wrist, a hole in one leg, and serious cuts and abrasions to her hands. The driver of the other vehicle left the injured couple and their demolished motorcycle in the roadway without stopping.

Court Date

Montgomery has been ordered to appear before the court on December 11, where his trail date will be set. If convicted, the hit and run driver faces up to 12 years in prison. He is currently in jail on $120,000 bail.
