Details on the Traffic Collision Fatality Reported in Turlock

A preliminary report by CHP traffic officers who responded to the scene revealed that a vehicle traveled down an embankment near Taylor Road just south of the State Route 99 on-ramp. Officials indicated that the car may have overturned several times before striking trees in the area. The vehicle came to a rest on its roof close to the railroad tracks.

Sadly, authorities requested a coroner from the Stanislaus County Sheriff’s Department to the crash site. The man was identified as a resident of Dinuba in Tulare County. Additional information on the fatal car accident was not immediately available.

Things You Should Know About Fatal Rollover Accidents and Wrongful Death Claims

Losing a close relative is always difficult, regardless of the circumstances involved. However, it may be especially painful when it is discovered that the loss was caused by someone else’s carelessness or negligence and may have been prevented. While bringing a lawsuit may be the last thing on survivors’ minds during this difficult time, obtaining justice and compensation may be crucial in the healing process.

When deciding whether or not to retain a Turlock personal injury attorney experienced in handling wrongful death cases, there are many things to consider. One of which may include the importance of collecting and preserving evidence immediately after a fatal car wreck. The reason being that if the incident involved a rollover, there may be other parties at fault for the incident that only an independent investigation by a skilled injury attorney may reveal.

For instance, if a vehicle overturned in a fatal crash, it is possible that the car roof may have failed to meet Federal Motor Vehicle Safety Standard 216 on roof crush resistance and protection of vehicle occupants. An automaker may be held liable for resulting damages through an auto products liability claim under such circumstances. Conversely, a government entity may be held financially accountable for an accident caused by a road defect. These are some of the many reasons why it is essential to work with an attorney early in the legal process. Types of Wrongful Death Compensation Available for Surviving Family Members

Sudden death may create immense financial hardship for the family left behind to pick up the pieces. If the loss was caused by the negligent acts of another party or entity, survivors should not have to deal with such burdens alone. An experienced Turlock wrongful death attorney may seek the recovery of economic and non-economic damages on their behalf from at-fault parties. This may include:

  • Medical Bills: In some wrongful death car accident cases, the decedent may have received treatment for the final injury they suffered. Survivors may seek the recovery of end-of-life medical expenses through a survival action filed against the at-fault party.
  • Funeral Costs: The costs of a funeral and burial may be staggering. Fortunately, the survivor who paid for such bills may be compensated through a wrongful death claim.
  • Loss of Society: Having close ties with our families is integral to our well-being and happiness. When a loved one’s life is taken away unfairly because of someone else’s carelessness or negligence, surviving family members may seek compensation related to the loss of society, protection, care, guidance, and companionship.
  • Loss of Support: Beyond the loss of companionship, surviving family members may have also depended on the support and assistance of the decedent in their lives. This may include housework, childcare, and other tasks that survivors must now find another means of fulfilling.
  • Mental Anguish: Few events in life are as devastating as the loss of a loved one, particularly more so when it was sudden. Such pain may not only impact the quality of life for surviving family members but may also affect one’s well-being. California law allows survivors to be compensated for such anguish.

Punitive damages, on the other hand, are awarded to surviving family members as a way of holding the at-fault party liable for their egregious conduct. Punitive damages are not intended for compensating survivors for their losses.
