Accident Under Investigation to Determine Cause

It has not yet been reported whether alcohol consumption contributed to the fatal two-vehicle crash. The section of Garden Highway where the accident occurred was shut down for around eight hours while detectives investigated the circumstances and how the collision occurred.

Placing a Claim for Wrongful Death

A two-vehicle crash often results in serious injuries or fatalities. When a negligent driver was the cause, the family may want to consider placing a claim for wrongful death. Over the years, our injury attorneys have helped many families recover compensation.

Families are left stunned when a loved one is lost in a two-vehicle crash. They are not only filled with grief and confused and angry at the at-fault party but wonder how this tragedy could have happened to someone they love. Filing for wrongful death will not ease their grief, however, it can help them obtain a sense of closure.

What Can Be Recovered in a Wrongful Death Lawsuit?

In a wrongful death lawsuit, some of the areas in which damages can be claimed include:

  • The funeral and burial expenses are recoverable.
  • The wages the deceased person would have earned at their job until the age of retirement can be recovered, including any pension benefits and bonuses.
  • Loss of inheritance can be claimed.
  • If the decedent was married, loss of consortium, love, and support they gave to their spouse can be recovered.
  • Children in the family can claim the loss of nurturing and guidance the deceased parent would have provided had they lived.
  • Loss of household services can be factored into the settlement. This includes work the decedent normally did around the house, such as childcare, mowing the lawn, and others.

Investigation of a Fatal Two-Vehicle Crash

In a wrongful death claim, evidence has to be gathered to show that the at-fault party was the cause of the family member’s demise. Among other areas:

  • Our investigators perform accident reconstruction, which shows the positioning of the vehicles that led to the fatal two-vehicle crash.
  • The witnesses to the accident are interviewed to determine what they saw and collect corroborating statements. Sometimes, a witness actually filmed the accident as it happened, which provides compelling evidence.
  • The police report is checked for errors.
  • Traffic and business cameras in the area are examined to see if any of them captured the fatal two-vehicle crash on tape.

Our team of injury attorneys uses this information and more to construct a case that supports our client’s claim.
