Can a Family File a Wrongful Death Case for a Pedestrian Accident?

Surviving family members of an individual who has lost their life in an accident through no fault of their own may be entitled to compensation for the loss of life. Eligible survivors can file a claim for wrongful death against the at-fault party to seek damages. These cases are not filed on behalf of the decedent. Instead, wrongful death cases are filed on behalf of surviving family members who suffered intangible harm and financial hardship due to the loved one’s demise. As such, close relatives may be reimbursed for mental anguish, loss of companionship, funeral costs, loss of financial support, etc.

California law is specific on who can file a wrongful death claim and who has priority for doing so. This generally includes the spouse, domestic partner, and children of the individual who passed away because of someone else’s negligence. This is by the CCP 377.60. If these relationships do not exist, other family members may be able to seek reimbursement. A skilled California wrongful death lawyer from AutoAccident.com can review the specifics of the case and determine if you have grounds for a claim for damages. We offer free consultations. What if the At-Fault Driver Left the Scene of a Vehicle-Pedestrian Crash?

When a motorist flees the scene of a car-pedestrian collision, that does not necessarily mean that recourse is not available. An injured party or a family member of a decedent may bring a claim through their uninsured motorist coverage to seek reimbursement for non-economic and economic damages. Before doing so, there must be a strong case with clear evidence backing up that a hit-and-run driver was responsible for the injuries or the loss of life. Retaining legal counsel is useful in these cases as there is a significant amount of time and work that goes into building a strong case for full compensation.
