What Can Be Recovered in a Wrongful Death Claim?
An immediate family member that meets the filing criterion of CCP 377.60 may seek reimbursement of economic and non-economic damages through a wrongful death claim. Eligible survivors may be compensated in the form of the following:
- Expenses for funeral services
- Bills for medical care (recoverable under a survival action)
- Mental anguish from the unexpected loss of a close relative
- The decedent’s financial contributions to the family, such as earnings and benefits
- Loss of the deceased’s companionship, care, love, protection, guidance, and society
When determining who is liable for damages in a wrongful death claim, there may be several negligent parties. An independent investigation into the incident to identify all at-fault parties is necessary. Fortunately, an experienced Dublin wrongful death lawyer can help by handling all aspects of the case from start to finish.
