What Can Be Recovered in a California Wrongful Death Case?

In a wrongful death claim, the surviving spouse, domestic partner, or children of the deceased are entitled to financial compensation for their loss. This is by the California Code of Civil Procedure Section 377.60 (CCP). If such parties are nonexistent, then the decedent’s stepchildren, parents, and putative spouse may be eligible to file for wrongful death. The court may award equitable and fair damages for the following:

  • End of life medical bills, funeral and burial expenses for the surviving family member who paid them
  • Loss of parental instruction, companionship, and guidance for surviving children
  • Loss of financial support and benefits the decedent would have provided to the family, like medical insurance and pension
  • Lost affection, companionship, and protection
  • The value of household services that the deceased provided to the family

How Long Do You Have to File a Claim for a Fatal Ceres Traffic Accident?

A wrongful death claim is subject to a statute of limitations. This means that a lawsuit must be filed within a specific amount of time. In California, there is a two-year statute of limitations or deadline for bringing a claim. If this filing deadline is not met, the court may dismiss the case, and the right to seek recovery may be lost. To avoid this from happening, hiring an experienced Ceres wrongful death lawyer is essential, so you and your family do not lose the opportunity to obtain justice and compensation for your loss.
