California Recovery of Compensation After a Dog Bite Injury

If you have suffered a dog bite injury in California, you may be entitled to compensation for your damages. California follows a “strict liability” rule when it comes to dog bite cases, meaning a dog owner is held liable for their dog’s actions regardless of whether the dog had shown prior aggression or the owner had no knowledge of the dog’s dangerous behavior. This law is outlined in California Civil Code Section 3342, which states that a dog owner is responsible for injuries caused by their dog if the injured party was lawfully present in a public or private place.

Types of Recoverable Compensation

Those injured by dog bites can recover compensation, including their medical costs, damages for their emotional and physical trauma, and wages because they could not work. The key is providing clear evidence of the injury, establishing the liability of the dog owner, and demonstrating the damages incurred as a result of the bite. Consulting an experienced personal injury attorney can help ensure your legal rights are protected and that you seek the full compensation you deserve.

Proving Your Dog Bite Case

To prove your dog bite case, you need to demonstrate that the defendant owned or was responsible for the dog at the time of the incident. This can often be achieved through witness testimony, licensing records, or other documentation. Next, you must show that the dog bite occurred and that it directly caused your injuries. Photographs of the injuries, medical records, and any eyewitness accounts can serve as compelling evidence in this regard. Keeping detailed records of all related expenses and impacts on your life will strengthen your case during settlement negotiations or in court proceedings.
