Recovering Damages Following the Loss of a Loved One

The sudden loss of a loved one leaves the family members grieving, in shock, and wondering why it had to happen. While making funeral preparations, they might suddenly realize that they not only suffered the loss but may be facing financial stress because of it. When a negligent driver was the cause of the loved one’s death, the family may want to think about filing a wrongful death claim. Areas where a claim for damages can be placed include:

  • Funeral and burial costs
  • Income, pension, and insurance benefits provided by the deceased until the year of retirement
  • Loss of consortium
  • Loss of inheritance
  • Loss of guidance and nurturing of the children
  • Loss of household services

How a Wrongful Death Lawyer Helps

A wrongful death lawyer can help a family recover damages following the loss of a loved one in a two-vehicle crash or other accident. Members of the immediate family can join together to file, which includes the spouse or putative spouse and children. The wrongful death claim can also include others who received at least 50 percent of their support from the decedent. By filing a wrongful death claim, the family not only obtains financial help but also receives justice for the demise of their loved one.

How to Help a Grieving Family

After a death in a family, close friends and other family members may want to assist them in their time of need. Below are some suggestions that may be helpful:

  • Call or visit with the family if it is permitted.
  • Bring a ready-made meal to the home. All too often, grieving families forget to eat.
  • Offer to do chores around the home, such as mowing the lawn or picking children up from school.
  • Offer to run errands such as picking up prescriptions or shopping.
  • Remember, grief continues long after the funeral service. Be there for the family members if possible.
