Two Killed After Truck Accident in Stanislaus County

Two Crows Landing residents were killed after a recent truck accident in Stanislaus County. The incident occurred around 6:50 a.m. on Highway 132 near Hart Road, just west of Modesto. A Volvo was headed south on Hart Road while a big rig was traveling west on SR-132, according to the California Highway Patrol (CHP). For unknown reasons, the Volvo was broadsided by the big rig at the intersection. Both vehicles came to a rest in a field near the intersection. The driver of the large truck, a 39-year-old Tracy resident, was uninjured in the collision. Sadly, the driver and passenger of the Volvo both passed away at the scene. The Stanislaus County Coroner’s Office has identified the decedents as 22-year-old Damian Avina and 28-year-old Luis Gariba-Avina, both residents of Crows Landing. A GoFundMe page has been created on behalf of the Avina family to help cover both of their loved one’s funeral and burial services.

Loss of a Family Member

The loss of a close relative is devastating. When that loss is the result of someone else’s negligence, the pain is only intensified. If you and your family have lost a loved one in a truck accident caused by a negligent trucker or trucking company, an experienced Modesto wrongful death lawyer can help. An attorney is dedicated to protecting the rights of a family and holding negligent parties accountable for their wrongdoing. As part of the wrongful death claims process, a lawyer can help recover fair compensation to secure a family’s future. This way, the family can focus on grieving and moving forward from their loss without worrying about finances.

How Are Truck Accidents Different From Car Wrecks?

Wrongful death claims against commercial trucking companies and truck drivers are not the same as other motor vehicle accident cases. Many federal regulations are often involved in truck accidents, such as insurance coverage. For instance, a commercial truck transporting nonhazardous cargo weighing over 10,000 pounds is required to carry at least $750,000 in liability insurance. This coverage serves to pay for personal injury, wrongful death, and property damage. Since the stakes are often high for insurers after a wrongful death truck accident, they may dispute any fact of the case to persuade a family to accept a low-ball settlement offer. Before you agree to a settlement from a trucking company or insurance claims adjuster, it is best to consult with an experienced Modesto truck accident lawyer to learn what options are available to you and your family for recovery. Damages Recoverable in a Stanislaus County Truck Accident Claim

The emotional and financial harms that a family suffers as a result of a loved one’s wrongful death are referred to as damages. These may include economic damages such as costs of a loved one’s end of life medical treatment, funeral and burial services, lost future financial support, and household services. Noneconomic damages may also be recovered through a wrongful death claim and generally include mental anguish and loss of a loved one’s protection, care, and companionship. The amount of compensation that a family is eligible to receive varies by case to case.
