Turlock Woman Killed in Highway 1 Crash

Details on the Crash on Highway 1 That Killed a Turlock Woman

The California Highway Patrol (CHP) revealed in a report that a 50-year-old Visalia man was driving a Kia Optima southbound on Highway 1. At the same time, a 71-year-old Turlock woman was driving a Honda CRV northbound on State Route 1. For unknown reasons, one of the vehicles reportedly attempted to make a left turn at San Luisito Creek Road and in the direct path of the other, causing both cars to collide.

Another car allegedly struck the front of the Kia following the initial crash, according to CHP traffic officers. The driver of the third vehicle was injured. However, the extent of their injuries was not immediately disclosed by officials. The Kia driver and the Honda driver both suffered serious injuries in the crash.

Sadly, a passenger in the Honda succumbed to her injuries during hospitalization. Officials have identified her as a resident of Turlock. However, her identity has been withheld by police due to pending notification of family members. Authorities have not yet released additional information on the fatal car accident near Morro Bay due to ongoing investigation.

Loss of a Loved One in a Car Accident

When an individual or entity acts in a negligent manner and causes bodily injury or death to others, they should be held accountable for the consequences of their behavior. In the case of a fatal car accident, this is possible through a wrongful death claim. Such cases are generally brought against the driver responsible for the crash and their insurance company for the recovery of economic and non-economic damages. This may include costs of end-of-life medical treatment (recoverable through a survival action), mental anguish, loss of companionship, loss of future financial support, funeral service expenses, and more. The right to the recovery of such losses is limited to the surviving spouse, domestic partner, or spouse, as outlined in the California Code of Civil Procedure Section 377.60. Other relatives may be eligible for filing if such relatives are non-existent.

It is never easy to discuss legal rights as a surviving family member. However, it is essential for survivors to be provided with the information necessary in making crucial decisions. That is why when a family experiences a loss of a loved one in an unexpected accident caused by the negligence of another party or entity, it is essential to retain legal counsel. That is because an accident attorney will have the best interests of the family at heart, something the insurance company may not have. Wrongful death claims are intended to provide compensation to the family of the decedent as a way of making them whole, but insurers do not always make that possible as they are looking to pay as little as possible to protect their profit margins. Hiring an experienced Turlock wrongful death lawyer may make all the difference in the outcome of the case as they will stop at nothing to obtain a successful resolution. How Much Time Do You Have to File a Wrongful Death Lawsuit?

In California, surviving family members generally have two years from the date of loss to file a lawsuit in civil court. Survivors must meet this filing deadline if an insurance settlement is not accepted within this time frame. Keep in mind that the two-year statute of limitations may be reduced in cases involving government entities to as little as 180 days. Therefore, protect your right to justice and compensation by retaining legal counsel who can ensure that such filing criteria and deadlines are met accordingly.
