Turlock Man Arrested Following DUI Accident

I’m Ed Smith, a Turlock car accident lawyer. A hit-and-run accident involving a drunk driver occurred near Hilmar during the morning of Tuesday, March 6, 2018. The suspect was later apprehended by authorities and has been charged with felony driving under the influence (DUI) and hit-and-run.

What Happened?

A Turlock man was driving his 2007 Lexus sedan northbound along Highway 165 near Echo Street at approximately 5:00 am. The Lexus was reportedly traveling at a high rate of speed and attempted to overtake a vehicle in the left turn lane. While doing so, the Lexus failed to stop in time and broadsided a 2003 Nissan Frontier that was attempting to turn left onto Echo Street. The Turlock man allegedly fled the scene following the collision, leaving the Nissan driver behind to suffer from their serious injuries.

Nature of Injuries

The driver of the Nissan, identified as a 55-year-old Hilmar man, suffered minor lacerations and complained of pain following the auto accident. The Hilmar man claimed that he would seek medical attention at an urgent care facility and declined medical transport.

Hit-and-Run Driver Arrested

Investigators located the driver of the Lexus sedan at his home and brought him back to the area of the accident. Authorities conducted a toxicology test on the suspect, who was determined to be driving under the influence of alcohol leading up to the crash. The suspect, identified as 34-year-old Jose Arriega-Partida of Turlock, has been charged with hit-and-run and felony DUI. He will be booked into the Merced County Jail following his discharge from hospitalization.

Hit-and-Run Accidents in California

Hit-and-run accidents are extremely unpredictable, especially in California. A 2015 report by the California Office of Traffic Safety (OTS) indicated that approximately 234 hit-and-runs occurred in Stanislaus County alone. While hit-and-run drivers sometimes escape liability, an injured party may have recourse through their own insurance policy.

Importance of UM Protection

When you are the victim of a hit-and-run accident, you may be unsure how you will be compensated for incurred damages without the identity of the fleeing driver. In these cases, you may fall back on your own automobile insurance policy if you are insured through Uninsured/Under-insured Motorist Protection (UM). Filing a personal injury claim through a UM policy may be stressful and time-consuming without the assistance of a seasoned Modesto personal injury lawyer. Having an experienced attorney by your side is crucial in securing your right to fair restitution.
