Why You Need Advice From a Carmichael Personal Injury Lawyer

Being injured in any type of accident can leave you with high medical costs from treatment and hospitalization, lost wages because you cannot work, and the pain and suffering that goes along with your trauma. If your injury was caused by the negligence of another person or entity, you may be able to place a claim for compensation against the at-fault party. This allows you to recover those expenses, which include:

  • All medical costs from ambulance service to hospitalization, physician bills, medications, and rehabilitation can be recovered.
  • Lost wages, including any bonuses, are recoverable and can be factored into the future if the injury is expected to continue.
  • Pain and suffering is recoverable, which not only includes the physical trauma but the emotional and psychological damage your injury caused.

Causes of a Traffic Injury to a Pedestrian

Pedestrians are vulnerable to injuries in a traffic accident because of a lack of a protective barrier and easy visibility to drivers. However, pedestrians have the right of way, and a motorist who injures one may be liable for a traffic injury. Some of the ways a pedestrian injury in a collision with a motorist occurs are:

  • In a parking lot, the driver may back out of a parking space or turn into a lane without looking carefully for a pedestrian.
  • Intersections are prime locations for pedestrian accidents. They are usually caused by a negligent driver who makes an unsafe turn or speeds through an intersection without regard for someone who is in the crosswalk.
  • Government negligence can be the cause of a pedestrian traffic injury. From poorly designed intersections to bad lighting or a malfunctioning traffic signal, the government entity in charge of maintenance, design, and repair may be held liable for a traffic injury.
  • Intoxicated drivers are a major cause of pedestrian accident injuries. Because their vision, judgment, and reflexes are affected by alcohol consumption, not just pedestrians but other motorists are in danger when a drunk driver is on the road.
  • Distracted drivers may be texting, chatting on a phone, eating, or checking their GPS instead of concentrating on surrounding traffic. As the number one cause of all types of accidents, a distracted driver can easily cause a pedestrian accident.
  • Speeding is a cause of many accidents each year, including those with pedestrians. A speeding driver may lose control of their vehicle or spot a walker up ahead and not have enough time to stop to avoid striking them.
