Losing a Loved One

We are never prepared to lose a loved one unexpectedly. Yet, it happens every day. This causes family members to react with a mix of grief, anger and a strong need for justice when their loved one was killed by the negligence of a person or entity. Reaching out to clergy, close family members, and friends can bring a measure of relief, but nothing or no one can bring back the comfort and love that suddenly is gone.

Justice for a Loved One

Whether the act that caused a loved one’s death involves criminal consequences or civil repercussions, finding justice for a family member’s demise is important. In both instances, the family can file a wrongful death lawsuit. This is aimed at punishing the negligent party financially and helping the grieving family obtain monetary support.

Why Is It Important for a Family to Be Financially Strong?

After the death of a loved one, family members often find themselves financially striving to cover end-of-life expenses and a lack of monetary support. Some of the costs covered in a wrongful death claim are:

  • The cost of funeral and burial expenses
  • Loss of the support supplied by the descendant such as wages (current and in the future), retirement funds, and life insurance
  • The cost of hiring someone to do household and other tasks normally done by the decedent
  • The loss of inheritance survivors may expect
  • Loss of nurturing and emotional support the decedent provided
  • Loss of companionship and love
  • Loss of consortium

By enabling the family to receive such monetary support, their ability to maintain expenses conforms to the wishes of the decedent and the family’s needs.

Investigating a Traffic Fatality

Whether the cause of the traffic fatality is a single-vehicle accident or one involving several vehicles, finding evidence that points to negligence is vital. That is why we send our investigators to the accident scene to determine who or what was at fault. A single-vehicle crash adds extra elements that also must be investigated.

The investigators begin by performing accident reconstruction that enables them to trace vehicle positioning throughout the vehicular crash. They also speak with witnesses and obtain video footage of the collision.

A single-vehicle traffic fatality poses additional questions the investigators must evaluate. For instance, the driver may have found that due to brake or steering defects, they lost control of the vehicle. This defect reverts back to the manufacturer, and filing a claim against the automotive company is necessary. Likewise, a defective tire blowout may lead to a traffic fatality. To enable such examination, it is crucial that the vehicle be preserved after the accident.
