What Should I Do After a Southeast Fresno Car Accident?

Your priority after you have been injured in a car wreck is to seek immediate medical care. Even if you believe your injury is minor, others may take time to present themselves, such as a traumatic brain injury. If you have passengers in your vehicle, check on them to see if they need medical treatment. If you can, exchange information with the other driver, including insurance policies and carriers, vehicle year, make, and model, and license plate numbers. If anyone saw the accident, speak to those witnesses and ask for their contact information. It is also essential to take photos with a camera or cell phone of the vehicles involved in the accident, street signage, and skid marks in the road. Contact the police to have a traffic collision report taken at the scene. By following these steps, you can protect yourself from liability issues that may come later with insurance companies.

Will the Other Insurance Company Contact Me?

After a car accident, you may receive calls from the insurance company representing the negligent driver. It is best to report that the crash happened, and property damage to your vehicle occurred as a result. Avoid discussing the personal injury portion of your claim. Insurance companies are focused on their bottom line. This means they will find any way to dispute your claim and settle it for the lowest amount possible. They do not have your best interests at heart. This is why it is essential to have an experienced Fresno personal injury lawyer deal directly with insurance companies so you can focus on recovering from your injuries without legal worry.

What Type of Compensation Do You Get for a Car Accident?

A personal injury claim is intended to make an injured person whole after a car accident. Compensation through these cases comes in two types, economic and noneconomic damages. Economic damages are generally easy to calculate since they are based on bills, receipts, and paycheck stubs. Noneconomic damages are often challenging to quantify. They will vary in value based upon the type and severity of injuries suffered, as well as the effects of that trauma on an injured person’s life. A personal injury case may lead to the recovery of past and future medical expenses, past and future lost wages, disfigurement, loss of consortium, and pain and suffering. Conversely, specific factors may affect the value of a claim for personal injury. To learn what these are, watch the video below.

How Long Do I Have to File for Personal Injury?

Most personal injury cases must be filed within two years from the date of a car accident. This is by the California Code of Civil Procedure Section 335.1. There are some exceptions to this filing deadline, one of those involves negligent acts by government entities. In such situations, a notice of claim must be filed within six months or 180 days under the California Government Code 911.2. Failing to meet these statutory deadlines may result in the dismissal of your personal injury case by the court.
