How Can a Wrongful Death Case Help Our Family?
A wrongful death claim is intended to make a family whole again after the loss of a loved one. Survivors may receive compensation for financial and intangible losses, such as mental anguish, lost companionship, loss of financial support, funeral and burial costs, medical treatment costs associated with the final injury, and more. While no amount of money can make things right again for a family after the tragic and sudden loss of a loved one, it may help provide them with the means for a more secure future. Aside from this, it may also provide a sense of justice and closure for the loss of a close relative, knowing that the at-fault individual or entity have been held liable for damages incurred.
There are many steps in the wrongful death claims process that must be met. Remember that California law restricts the amount of time a family must file a wrongful death matter in civil court. A two-year statute of limitations generally applies, meaning that survivors must file a lawsuit in court if a mutual settlement agreement is not reached within that time limit. Insurance carriers may be difficult to work with, so working with an experienced attorney is crucial to the outcome of a claim. Retaining legal counsel to start the process is essential to gathering and preserving evidence before it is lost or destroyed.
