What is a Wrongful Death Claim?

When a loss of life occurs in an accident caused by negligence, it may constitute wrongful death. A wrongful death claim in California may involve many causes, such as motor vehicle collisions and other types of accidents. If a loved one was lost in a crash, surviving family members may have grounds for a wrongful death action. This type of case serves to help make survivors whole again.

Financial recovery may include reimbursement for medical bills, funeral costs, mental anguish, lost companionship, loss of future support, wage loss, and more. An experienced wrongful death attorney from Fresno can review your family’s case to determine the potential damages available in your situation.

As a surviving family member, you do not have to go into your savings to afford an attorney. Most lawyers work on contingency, meaning attorney’s fees will be contingent based on the outcome of your case. Your family does not have to worry about hourly rates, retainers, or upfront costs. This will allow you and your family to focus on feeling better while your accident attorney works toward a favorable resolution on your behalf. Seeking justice and financial compensation for your loss starts with a free consultation with an experienced wrongful death lawyer in your area.

How Much Time Does a Family Have to File a Wrongful Death Lawsuit?

Generally, California law allows surviving family members just two years to file a wrongful death lawsuit. According to the California Code of Civil Procedure Section 335.1, the time survivors must file suit starts on the day the fatal incident occurs. Failure to file a lawsuit on time may result in losing the right to seek financial compensation from the other side.
