Why It Is Helpful to Work With an Experienced Attorney

The purpose of a bodily injury claim is to make an injured individual whole again after someone else’s negligence causes them harm. A lawyer will seek full compensation on behalf of their client for economic and non-economic damages that reflect how their life was changed because of the accident. Some of the losses an attorney can seek include past and future medical bills, past and future lost earnings, pain and suffering, loss of consortium, and more. While taking legal action may be the least of your concerns while recovering from a crash, the right lawyer can improve your chances of a favorable case result.

Compensation for injuries and losses from a traffic collision is generally obtained through a settlement agreement, meaning most cases are settled out of court. However, it may be necessary to litigate a matter if a mutual settlement agreement cannot be reached between the plaintiff and the insurance company representing the at-fault party. An experienced personal injury lawyer will likely need to file a case in civil court against the other side if a mutual agreement is not reached within the applicable deadline to protect the statute.

California law requires that all motorists carry liability insurance. There must be coverage available to compensate individuals who suffer injuries and losses in accidents caused by the negligence of others. If it is determined that the opposing party does not have auto insurance, a skilled lawyer will work to identify other sources of monetary relief, such as their client’s uninsured motorist coverage. In cases where the client’s losses exceed the at-fault party’s insurance limits, an attorney will work with the client’s insurer through an underinsured motorist claim.
