Loss of a Child in a Turlock Car Accident

When a child is lost, it may be challenging to come to terms with what the future may be like without them. If the loss was caused by negligence on the part of another party or entity, the family may be able to recover financial compensation for their loved one’s wrongful death. While no amount of money can ever make up for the loss of a child, it may help ease the unexpected financial hardships experienced by surviving family members.

What Damages Are Available in a Wrongful Death Case?

Assessing economic and noneconomic damages for the wrongful death of a minor may be challenging. Compensation in such cases may include financial and intangible losses, such as:

  • Death-Related Expenses: These may include medical bills, including end-of-life treatment (recoverable through a survival action), and costs of a child’s funeral and burial
  • Noneconomic Losses: This consists of the loss of the minor’s comfort, love, care, companionship, and moral support for surviving family members
  • Mental Anguish: This takes into consideration the emotional suffering experienced by a family for the wrongful death of a child

Who Can File a Wrongful Death Claim?

In California, parents of a deceased child are generally entitled to wrongful death damages. If the parents are no longer alive, others may be eligible for filing a wrongful death claim. This may include the deceased minor’s siblings or grandparents.
