State Route 99 Pedestrian Injury Accident Involves Hit-and-Run Driver

A pedestrian injury accident happened near Susanville on July 13. The driver of the vehicle that struck them ran from the scene. The collision occurred on State Route 89 between Canyondam and Crescent Mills around 11:12 a.m.

Patient in Pedestrian Injury Accident Airlifted to Hospital

The report issued by the California Highway Patrol (CHP) stated that serious injuries occurred to the walker and an air ambulance was summoned to the site to transport that patient to a hospital. The fleeing suspect in the case was identified by authorities, but information was not released on whether that person had been located. CHP traffic accident investigators are working on the case to determine how it happened.

Hit-and-Run Drivers and Accidents Involving Pedestrians

Pedestrians are the most vulnerable to serious injuries in an accident, compared with those in motor vehicles. When a hit-and-run driver is the cause, it can be an arduous process to locate the person responsible. When they are found, the fleeing driver can be held financially liable for the pedestrian’s injuries and other losses, such as the following:

  • Medical: Expenses related to the accident, such as hospitalization, surgeries, tests, doctors’s fees and others can be recovered, including costs that are out-of-pocket.
  • Earnings: Wages that are lost because of the pedestrian injury accident are recoverable. If the worker cannot return to their previous job and has to take one that pays less, the difference in salary is recoverable. If the injured party can no longer work due to permanent disability, the salary is recoverable until retirement age.
  • Benefits: Many people receive benefits at work such as bonuses, tips and pension or insurance. Those items are also recoverable.
  • Noneconomic damages: Noneconomic damages from your pedestrian injury accident include your physical pain and suffering as well as compensation for your psychological or emotional trauma. In about 33 percent of all car accidents, people suffer post-traumatic stress disorder and require professional care to treat it. The cost of that care is also recoverable.

The lawyer handling your case can negotiate with the at-fault driver’s insurance company to recover the compensation you deserve. If the driver’s insurance is insufficient, the case can be taken to civil court to recover a judgment in the amount you need to cover your losses.

Insurance Coverage to Recover Medical and Other Expenses

When the driver who caused the injury is uninsured or doesn’t have sufficient means to pay for your losses, there is another option. The injured person can use their own uninsured/underinsured coverage. If the injured party doesn’t carry this add-on insurance, but a family member has it, that can be used instead. The cost of the policy remains unaffected.
