Power Inn Road Collision Leaves Pedestrian With Critical Injuries

A Sacramento pedestrian suffered critical injuries on April 28 when they were struck by a motor vehicle. The Sacramento pedestrian accident happened at about 4:00 in the morning at southbound Power Inn Road and Cucamonga Avenue, south of Folsom Boulevard. Medics transported the pedestrian to a local hospital for treatment of the injuries. No update has been provided on the pedestrian’s condition.

Power Inn Road Shut Down for Three Hours Following Accident

The driver who struck the person on foot remained at the accident scene and cooperated with Sacramento Police Department officers who were investigating to determine how the collision happened. The road reopened to traffic about three hours after the collision.

Sacramento Pedestrian Vulnerability in a Motor Vehicle Collision

Because, unlike motor vehicles, pedestrians have no protection in a crash, catastrophic injuries and fatalities are common. The speed of a vehicle is an important factor in a Sacramento pedestrian accident. According to the American Automobile Association Foundation, when a vehicle is moving at 16 mph, a pedestrian has a 10 percent risk of suffering a serious injury. By the time a vehicle is moving at 46 mph, 90 percent of pedestrians will suffer a severe injury.

Placing a Claim for Pedestrian Injury Compensation

As in most other personal injury claims, negligence by another person or entity has to be shown as the cause of the Sacramento pedestrian accident. This is proved by gathering evidence to support the client’s injury claim. Some of the evidence is gathered by performing the following:

  • Our investigative team goes to the Sacramento pedestrian injury site right away to search for evidence.
  • The report filed by the police is examined to ensure its accuracy. Mistakes in the police report can affect the ability of the client to file an injury claim.
  • Witnesses to the accident are interviewed. Their ability to agree with how the pedestrian injury accident happened provides evidence in the case. In addition, there are times when a witness managed to capture the accident on their cell phone.
  • Surveillance cameras in the area are examined. If a surveillance camera captured the Sacramento pedestrian accident, it provides strong evidence, which is used in negotiations with the insurance company and in court.
  • Accident reconstruction is performed, which shows how the accident occurred.
  • The area is examined for signs of maintenance neglect. In these cases, the government entity responsible for that maintenance may be held accountable.

Once the investigators are finished gathering the evidence for the client’s claim, it is handed over to our injury attorneys. They use this evidence to build a case that supports our client’s compensation claim. It can be used when we are negotiating on the client’s behalf with the insurance company. In cases where the insurance company refuses to pay what the injured client deserves, the claim can be taken to civil court, where it will be decided.
