Overnight Crash Causes Fatality and Injuries in Sacramento

A fatal car crash with two injured occurred in North Sacramento on August 1 in the middle of the night. The accident happened when a single vehicle was involved in an accident at the Marconi Avenue intersection with Connie Drive at about 1:00 a.m. First responders with the Sacramento Fire Department responded to the accident call, where they discovered one individual had died at the scene.

Fatal Crash Being Investigated to Determine Cause

The other two people in the vehicle were taken to a nearby hospital for treatment. No additional information was provided on their conditions. The name of the deceased has not yet been released pending notification of the family by the County Coroner’s Office. The accident is under investigation to find out why it occurred and how.

Making a Claim for Wrongful Death

Filing a wrongful death claim may help provide compensation to your family if your loved one died as a result of a negligent driver. While grieving over their loss and having to make unexpected funeral arrangements, many families consider filing a wrongful death lawsuit against the responsible party to hold them liable for the action that took their loved one’s life.

Assembling the evidence that supports the claim and calculating the damages that can be recovered are some of the tasks an accident attorney can assist you with as well as handling negotiations with the insurance company of the at-fault driver. By doing so, it can give the family members a sense of justice, punish the wrongdoer and help the decedent’s loved ones move forward, even if it does not ease the grief they feel.

Wrongful Death Claims Can Be Filed by What Family Members?

Wrongful death claims can be filed by members of the deceased’s immediate family in California. The spouse and children in the family who obtained at least half their support from the decedent can join together to file. The estate administrator may also file. Only one lawsuit can be filed, so the family and estate administrator should work out the details.

What Wrongful Death Claims Can Recover

When filing a wrongful death claim, certain factors are taken into account, including the deceased’s age. Awarded damages can be economic and non-economic, with the former having a monetary value and the latter being intangible. In most cases, however, damages are awarded in the following forms:

  • Burial and funeral costs
  • A deceased person’s future earnings until retirement age as well as insurance and pension benefits and others
  • Involvement in household duties like cleaning, auto care, tax preparation, and household maintenance that the decedent provided
  • Loss of inheritance
  • Compensation for the spouse having lost the deceased’s companionship, consortium, and social interaction
  • A parent who has passed away leaves no guidance, advice or nurturing for the family children, which can be compensated
  • Family members’ grief and suffering after losing a loved one
