The report stated that the pedestrian ran through the highway lanes going southbound and jumped the center divider when they were struck by a Budget moving truck. In addition to the moving truck, a BMW and a Dodge were also involved in the crash. SacFire medics discovered the pedestrian lying in the center divider, and the Sacramento County Coroner was called to the scene to declare them deceased.

Identity of Deceased Pedestrian Pending Family Notification

A SigAlert was issued as the area of the fatal pedestrian accident was cleared. The accident is under investigation by the CHP traffic crash unit to determine what happened. The County Coroner’s Office will release the name of the deceased pedestrian after family members have been notified.

Wrongful Death Claims in California

When a pedestrian is killed in California, the decedent’s family needs evidence to support their wrongful death claim if negligence by another individual or entity was the cause. By enlisting the help of an accident attorney, family members have the support they need to compile that evidence in a fatal pedestrian accident and handle their claim, whether it is through the at-fault person’s insurance company or taken to court.

Evidence Collection in Wrongful Death Cases

The following evidence supporting wrongful death claims can be examined by an attorney in traffic collision cases. Evidence collected may include the police report, accident reconstruction, traffic surveillance footage, pictures of the scene, witness statements and others. Once the evidence has been compiled, the attorney uses it to build a compelling case that supports the client’s claim.

California Wrongful Death Lawsuits: What Can Be Recovered?

Some factors influence how much the family can recover by filing a wrongful death lawsuit, such as the age of the decedent and their wages. A wrongful death action under California law, however, can result in an assortment of compensation, including:

  • Wages earned until retirement age and benefits that came with the job, such as bonuses, pension, and insurance are recoverable.
  • Recovering funeral and burial expenses is possible.
  • The family may be able to assert a claim for loss of consortium, love, counsel, advice, protection and moral support provided by a deceased person.
  • Cleaning, repairs and other household tasks that were likely provided by the deceased on a regular basis, could be recouped.
  • An at-fault party may be liable for punitive damages if he or she acted recklessly or maliciously.
