Police Requesting Help with Sacramento Car Accident Investigation

Once the family of the deceased man is notified of the fatal accident, the name will be released. Police are requesting that anyone who has information about the accident to phone (916) 443-4357.

Traffic Collision Fatalities and Injuries

There are many car accidents at intersections, and they are often fatal. The majority of these crashes are due to driver negligence, such as speeding or being distracted. Others are related to outside influences, including roadway negligence and defects in auto parts.

Roadway Negligence

When roadway maintenance is neglected, the driver may experience a disrupted view of the roadway, hit a pothole that causes the motorist to lose control or other problems that lead to a Sacramento car accident. The government entity that is supposed to maintain the roadway may be held liable, but the time in which to file is limited to six months, so obtaining help from an accident attorney may be wise.

Defective Auto Parts

A tire that blows out, brake failure and other mechanical problems can cause a Sacramento car accident. An auto product liability claim may be filed against the manufacturer in these cases.

Traffic Accident Wrongful Death Claims

Various types of compensation can be recovered following a traffic accident by filing a wrongful death claim. The immediate family of the decedent may recover compensation for the following financial and emotional losses:

  • Wages the deceased person could have earned until retirement can be recovered by the family, including benefits.
  • The spouse may claim loss of consortium and companionship.
  • The family children may claim a loss of guidance and nurturing due to the loss of their parent.
  • The funeral and burial expenses are recoverable.
  • Loss of inheritance can be recovered but not in all cases.
  • Household assistance provided by the decedent is recoverable if it was something they performed on a regular basis. Household assistance refers to work the deceased person did around the house, such as servicing the family cars, yard and house work, childcare, cooking, cleaning and others.

Only one wrongful death claim may be filed. Usually, the spouse and children file the claim. However, the estate administrator may choose to do so instead. If the decedent had no spouse or children, additional family members who may file include parents and siblings of the deceased.

A wrongful death lawsuit can be explained in the video below, which was created by attorney Ed Smith:
