Riverbank DUI Accident Fatality

A Riverbank DUI accident fatality occurred on the night of February 13 along Claribel Road just east of Langworth Road. The driver of a disabled 2016 Ford F-150 pickup truck, a 23-year-old Portola man, had his hazard lights on to alert oncoming traffic. A 1982 Chevrolet Silverado driven by a 56-year-old Salida man was approaching the Ford and reportedly failed to notice the pickup. The Chevrolet struck the Ford, veered off the road and crashed into a ditch along Claribel Road. The impact of the collision caused severe damage to the cab of the Chevrolet. The driver and passenger of the Chevrolet were both transported to local hospitals for treatment. Sadly, the passenger succumbed to his injuries during hospitalization. Officials have identified the decedent as Robert Dale Rodgers, a 64-year-old Salida man. Our thoughts and prayers are with the friends and family of Mr. Rodgers in their time of loss and sorrow.

Investigation of the Riverbank DUI Accident Fatality

According to the California Highway Patrol (CHP), the Chevrolet driver was arrested by authorities after being released from hospitalization. He was booked into Stanislaus County Jail on charges of driving under the influence of alcohol, DUI causing bodily injury, and gross vehicular manslaughter while intoxicated.

Drunk Driving and Auto Accidents

There is a high number of effects alcohol can have on a driver. From memory loss and impaired perception to lack of reaction time and poor decision-making skills, these effects can significantly increase a driver’s chances of an accident with an innocent party. According to the National Safety Traffic Safety Administration (NHTSA), nearly 30 people passed away every day in drunk driving accidents in 2017. This number represented one fatality occurring every 48 minutes. Damages and deaths from these collisions contributed to a cost of $44 billion in 2010, the most recent year for which comprehensive data is available. Passenger Injury Claims

When a passenger is injured or lost in a car accident, there are a few avenues an injured party or family of a decedent can take to recover compensation for crash-related expenses. Depending on who is liable for the car wreck, a personal injury claim may be filed against the insurance policy of the driver or owner of the vehicle he or she was riding in at the time of the collision as well as the policy of the other cars involved. A passenger may also file a claim against their own uninsured/underinsured motorist protection. This is only possible if the passenger’s damages exceed the insurance policy limits of the at-fault driver or the motorist did not have insurance at the time of the collision. These claims must be filed within the statute of limitations which is two years in California. If a road defect played a factor in the crash, a claim may also be brought within six months or 180 days from the date of loss.

How a Law Firm Can Help

Losing someone you love is among the most painful things to experience in life. When you find out your loss was caused by wrongful death, your grief can be compounded by anger and frustration. The loss can force you and your family to confront high accident-related medical bills, funeral expenses, and other unexpected financial burdens. These economic concerns can make it even more difficult to recover from the tragic loss. An experienced wrongful death attorney in Modesto can help in these situations by easing your burden and recovering the compensation your family needs to move forward from your loss. While nothing can make up for the loss of a loved one, compensation from a wrongful death claim can help bring closure and lessen unexpected financial expenses during these difficult times.
