Filing a Personal Injury Lawsuit

You must typically file a personal injury lawsuit within two (2) years of the date of injury. When a claim is against a government entity (see next paragraph) you have significantly less time to file a claim. The time limits are known as Statutes of Limitations. If the injured victim is a person with a major mental disability or is a child, this period can often be extended beyond the two year Statute of Limitations.

Making a Claim Against a Government Entity

If you plan on making a claim against a government entity, the law typically requires you do so within 180 days or six (6) months of the injury causing incident.

I’ve been practicing personal injury law exclusively since 1982. During that time I have seen many severely injured people who have been barred from pursuing a claim against a negligent government agency because they failed to file the required paperwork within the six month time period. It is devastating for the victim and heartbreaking for me.

What if My Government Entity Claim is Rejected?

Typically, if your claim is rejected you must file a lawsuit within 18o days of such rejection.
