Loss of a Loved One

One of the most devastating events in life is the loss of a loved one. The unexpected and untimely death of a close relative may cause extraordinary grief, especially when it was the result of someone else’s conduct. Wrongful death occurs when recklessness or negligence results in the loss of life. California law provides surviving family members with the right to recover financial compensation under these circumstances. While no amount of money can undo the pain or bring a family member back, compensation, and justice from a wrongful death case can help provide for a family’s future. For more details on these types of cases, watch the video below.

Types of Wrongful Death Compensation for Survivors

Surviving family members may be able to seek financial compensation through a wrongful death claim. The amount of recovery available to survivors will depend upon the facts and circumstances of the case, but a dedicated Fresno wrongful death attorney can help a family obtain the justice and compensation they deserve. Under a wrongful death action, relatives may be eligible to receive economic and non-economic damages for:

  • Costs of a loved one’s funeral and burial may be claimed by the surviving family member who paid for them
  • Expenses for end of life medical treatment related to the fatal pedestrian accident may be recovered through a survival action
  • Lost income, benefits, household services, and future financial support the decedent would have provided to the family if not for the wrongful death pedestrian accident
  • Punitive damages may be available in some wrongful death cases involving pedestrian accidents where the actions of the driver were determined to be particularly egregious (e.g., excessive speeding or drunk driving)

Importance of Working with a Fresno Attorney After a Wrongful Death Pedestrian Crash

When filing a wrongful death lawsuit after the loss of a loved one in a pedestrian accident, it is essential that you have an experienced attorney on your side. The at-fault party’s insurance company and their team of defense attorneys may attempt to minimize or deny your claim. They may also contact your family in your time of loss and use that to their advantage to settle your case quickly and only offer a small amount while doing so. Before signing any documents or accepting any settlement offers before filing a wrongful death claim may release the negligent driver from future liability for the incident. Having an attorney in these situations means you and your family can focus on grieving and recovering from your loss without having to deal with insurance companies, defense counsel, and legal paperwork and deadlines. Your Fresno wrongful death attorney can handle all aspects of your case.
