Pedestrian Killed After Accident in Central Fresno

A person was killed after a recent pedestrian accident on East Shields Avenue and North Maroa Avenue in central Fresno. At approximately 9:15 p.m., the Fresno Police Department (Fresno PD) responded to the scene of a fatal collision involving a pedestrian and a motor vehicle. The driver of the car claimed to not have seen the pedestrian crossing the street and crashed into them, the Fresno PD reported. Sadly, the pedestrian was pronounced deceased on-site by authorities. The Madera County Coroner’s Office has identified the decedent as 27-year-old Isaac Romero of Fresno.

Loss of a Loved One

When a family has been confronted with the unexpected loss of a loved one, this is no doubt one of the most challenging experiences in their lives. The loss of a beloved relative can be unimaginably painful, especially when it was caused by the negligence of another party or entity. When this happens, a grieving family may be able to hold the person financially responsible for the fatal accident through a wrongful death case. This may include recovery of funeral and burial expenses, loss of a loved one’s support and companionship, and lost income the decedent would have earned if not for the wrongful death pedestrian accident.

Does Insurance Cover Wrongful Death in a Central Fresno Pedestrian Accident?

The insurance company representing the at-fault party is generally responsible for covering the costs of a fatal accident in California. When the driver has little to no insurance, it can be challenging to seek compensation. Under such circumstances, the family of the decedent may file a claim against their loved one’s insurance company or their own to recover losses incurred. This is possible so long as they have uninsured/underinsured motorist coverage added to their policy. While the claim will be handled by their insurance carrier, this does not necessarily mean that they will be on their side when it comes to fair compensation. That is why it is best to retain experienced legal representation if your loved one was killed in a pedestrian accident caused by an uninsured or underinsured motorist.

Who Can File a Wrongful Death Suit in California?

There is a two-year statute of limitations regarding a wrongful death lawsuit in California. This means that a claim must be filed by a surviving spouse, domestic partner, or child within two years from the date of a loved one’s wrongful death. If a person who lost their life is not survived by a spouse, domestic partner, or child, then other relatives may be eligible to file for wrongful death. This includes the decedent’s putative spouse, stepchildren, or parents. For more information on who can bring a lawsuit for wrongful death, watch the video below.
