Pedestrian Injured After Hit and Run in Fresno

The Fresno Police Department (Fresno PD) are searching for a driver responsible for a hit and run accident that left a pedestrian injured on the night of Monday, June 8, 2020. The pedestrian accident occurred around 10:00 p.m. at Rialto Avenue and Blackstone Avenue in northwest Fresno. Fresno police said a man was crossing Blackstone Avenue when a driver of a dark-colored vehicle crashed into him at high speeds and fled the scene. Witnesses informed authorities that the driver did not reduce their speed nor use their brakes and drove away. The pedestrian injured in the hit and run accident was taken to a local hospital for treatment of unspecified injuries. An update regarding their condition was not immediately available. Anyone with information about the incident is encouraged to contact Fresno PD.

Recoverable Damages in a Pedestrian Accident Injury Claim

The following damages may be recovered in an injury case for a pedestrian accident:

  • Medical Expenses: An injured cyclist is entitled to the fair and reasonable value of all past and future medical treatment and expenses that have incurred as a result of the bicycle accident. Medical reports and expert testimony can be used to prove the full extent of these damages.
  • Lost Wages: When a bicycle accident-related injury prevents a cyclist from returning to work for a while, that party may be entitled to the reasonable value of missing time at work to recover from an injury or attend a medical appointment related to the bicycle accident. Hourly wages, bonuses, benefits, bonuses, and all other types of earnings are recoverable. This may also include a loss of future earning capacity, which refers to the inability to work as a result of permanent injury or disability.
  • Property Damage: The repair or replacement of personal belongings damaged in a pedestrian accident is recoverable. If personal property is beyond repair or completely destroyed, damages are generally calculated based upon the fair market value of the item at the time of the incident.
  • Pain and Suffering: Physical pain and emotional distress can be devastating to a person seriously injured in a pedestrian accident. This represents the noneconomic damages of a personal injury claim and includes compensation for past and future pain and suffering an individual may experience as a result of a pedestrian accident. The value of this damage will be based on reasonableness and expert testimony.
  • Punitive Damages: If it is proven that a pedestrian accident occurred as a result of egregious behavior on the part of the at-fault party, the injured individual may be entitled to punitive damages in a specific amount awarded by a jury as a way of punishing the negligent party. Such behavior may include excessive speeding or driving under the influence.

Should I Hire an Attorney for a Hit and Run Pedestrian Accident?

When it comes to recovering fair compensation for most pedestrian accident injury claims, most experienced Fresno personal injury lawyers look to the at-fault party’s liability insurance. If the person who caused the crash and resulting injuries had insufficient or no insurance at all, the injury lawyer would look at other viable options for recovery. This may include filing an uninsured/underinsured motorist claim (UM/UIM) with the pedestrian’s insurance policy. If the pedestrian did not have car insurance but lived with a household member who does, an UM/UIM claim may be filed with that policy. The only exception to this option is if the injured person was listed as an excluded member of the policy.
