Details on the Pedestrian Fatality Reported on State Route 99 in Turlock

A preliminary report by CHP traffic officers suggested that a pedestrian was walking in the area when he was struck by an unknown car that drove away from the scene. Sadly, the pedestrian, Thomas Kelly, 27, of Delhi, succumbed to his injuries shortly after the incident.

No details on the suspect and the vehicle involved in the pedestrian accident have been released by police. Those with information on the hit and run accident are encouraged to contact the CHP Modesto area office.

Loss of a Loved One

A pedestrian accident may be a traumatic and life-changing event. In a traffic accident between a vehicle and a pedestrian, the pedestrian often suffers the most significant harm because of their lack of physical protection. Most car-pedestrian accidents in California happen because of reckless and negligent drivers and often result in serious or even fatal injuries to pedestrians.

When you have lost a close relative in an accident caused by the negligence of someone else, you and your family should not have to worry about having to pay for end-of-life medical costs or funeral service expenses while grieving your loss. At the same time, you should not have to deal with difficult insurance companies looking to pay as little as possible on your wrongful death claim. Instead, you should consult a Turlock personal injury attorney who is experienced in handling fatal accident cases.

The amount of financial compensation available to surviving family members will depend on the facts and circumstances of the case. The types of economic and non-economic damages that may be recovered in a successful claim may include lost financial support, emotional trauma, mental anguish, loss of companionship, medical bills incurred for final injuries, and funeral costs. Punitive damages may also be recovered from the at-fault party if egregious actions resulted in a loss of life, such as excessive speeding or DUI. Do You Need an Attorney for a Wrongful Death Pedestrian Accident Case?

As a surviving family member, you may assume that the insurance company may be compassionate and sympathetic about your loss. However, that is not always the case, as insurers are not always willing to help survivors pay for damages caused by their insured. The unfortunate reality is that the same approach may also occur in first-party insurance claims brought under uninsured and underinsured motorist (UM and UIM) coverage for hit and run accidents.

The best way to ensure that you and your family receive a favorable case outcome is to seek the assistance of an experienced lawyer. An attorney will not allow the insurance carrier to take advantage of you during your time of loss and grief. Your lawyer will work diligently to obtain justice and fair compensation on your behalf in insurance negotiations or in court, if necessary.
