Who Can File for Wrongful Death

Family members who are supported at least 50 percent by the decedent can join a lawsuit claiming wrongful death compensation. This generally includes the spouse or putative spouse, children, including those who are adopted, and stepchildren if they are supported financially. A lawyer experienced in handling wrongful death claims can explain further what is entailed in filing against the at-fault party or their insurance company.

Following a Death

Although any time a friend or family member’s loved one dies is stressful and difficult, it is even more so when the life was taken because of someone’s negligent actions. The family members have no time to say goodbye and are shocked as well as grief-stricken. Following are some of the ways in which other family members, friends, and associates can show that they care and be supportive during this trying time:

  • Send a sympathy card, call to express your sorrow or send flowers or a donation to a charity in the loved one’s name.
  • Visit to offer a sympathetic ear. During times such as these, a grieving person needs to talk about their loved one. It is part of the stages of grief and can help them accept their loss.
  • Pitch in around the house because normal daily routines become upended following the death of a loved one. Washing the dishes, vacuuming, or mowing the lawn can provide help and show you care.
  • Offer to run errands or accompany a grieving person when they go out. This can be especially important if the grieving person’s spouse was lost and they are not used to going out unaccompanied.
  • If other family members are not present to help a grieving person to make funeral and burial arrangements, offer to go with them. This is a trying, difficult time, and having someone along who is emotionally supportive is important.
  • Once the funeral is over, make a point of staying in contact with the surviving family members. This shows them that you truly care about them and their loss.
