Who Can File a Wrongful Death Claim in California?

Surviving family members who have suffered financial losses and intangible harm because of a loved one’s wrongful death may be entitled to compensation. Under California law, specific survivors have grounds for a claim for damages. Those with filing priority usually include the deceased’s children, domestic partner, or spouse. Other relatives may be eligible for filing based on the facts and circumstances of the case.

A successful wrongful death case may result in economic and non-economic damages, like funeral service costs, loss of future financial support, mental anguish, loss of household services, loss of companionship, and more. If you and your family have recently lost a loved one in a pedestrian accident due to a negligent driver, you may want to discuss your case with a skilled California wrongful death attorney in a free consultation.

Importance of Working with a Wrongful Death Attorney

If a pedestrian accident deprived your family of a loved one and someone else is to blame for the incident, you deserve justice and financial recovery. Retaining legal counsel to handle your wrongful death claim can help you secure full compensation. Your attorney will evaluate your case, identify the economic and non-economic damages you may be entitled to, and calculate the maximum award you deserve.

An attorney that has years of experience handling fatal accident cases will evaluate the relevant facts and circumstances to build the strongest case possible. Your lawyer will negotiate a settlement with the insurance company and defense counsel in your favor. However, not all parties may agree to a settlement for a wrongful death claim. If that occurs, your attorney will take the case to court if necessary.
