What Should Surviving Family Members Know About Wrongful Death Cases?

The carelessness of drivers may have the potential to cause car vs. pedestrian accidents. This may be in the form of violating traffic laws such as running stop signs or red lights, not yielding the right of way to pedestrians in a marked crosswalk, making abrupt turns, driving while under the influence of alcohol or drugs, and speeding. In the case of a minor child, drivers have a higher duty of care to proceed with caution in an area where children are likely to be present. This may include school zones, parks, and neighborhoods. Failure to meet this duty may be deemed negligence. It is also essential to keep in mind that the determination of fault made by others, including insurance companies and the police, may be inconclusive or incorrect.

The unfortunate reality is that fault may be unfairly shifted onto a pedestrian. When the incident was fatal, surviving family members need someone to be their loved one’s voice and conduct an independent investigation of the pedestrian accident to properly determine fault. Fortunately, that can be accomplished by retaining legal counsel to handle all aspects of the case. Having a wrongful death claim for a pedestrian accident does not necessarily mean that the process of recovering fair compensation will be straightforward. It may be overwhelming and challenging to handle, particularly if there are difficult insurance companies and defense counsel involved.

Without an Antioch pedestrian accident lawyer, it is likely that important deadlines in the wrongful death case may be missed, evidence that may help prove the claim may be destroyed or lost over time, and surviving family members losing out on some or all the financial recovery they need. An experienced accident attorney can prevent this by building a strong case for fair compensation through working with expert witnesses, handling negotiations with insurers, and taking the case to court if necessary.
